Compliance with data protection regulations is a high priority for our company. In this context we would like to inform you about the collection of your personal data in the following:

Data processing for the fulfillment of a contract

We process the name, position, e-mail address and telephone number according to Art. 6 para. 1 lit. b GDPR for the purpose to fulfill a contract. This also comprises the associated customer service for processing orders and drafting contracts.
If necessary, personal data will be provided to the companies involved in the execution of this contract, such as suppliers of packaging materials and raw material supply or financial institutions for payment transactions.
The data which is necessary for the fulfillment of a contract will be deleted within 10 years after termination of the contract; during that time it will only be kept in order to be able to respond to queries. The data will not be deleted as long as there are any outstanding invoices which are to be collected. Should there be any legal retention requirements, the affected data will be archived for the prescribed period.

Data processing in pursuance of legitimate interests

We process your data (surgery/pharmacy/company name and address, title, first name, surname, position, E-Mail address, telephone and fax number) and other product-related information in order to be able to respond to your inquiry. The processing of your data is based on Art. 6 para. 1 lit. f GDPR and on our interest to provide the best possible service.
You have the right to object to the processing of your personal data. For more details, please see the following topic “Rights of the data subject”.

Data processing for direct marketing

We process your data for purposes of direct marketing in particular for the purpose of sending our advertising by post. The data processing is based on Art. 6 para. 1 lit. f GDPR and on our interest to inform you about new products and services. Every customer has a separate right to object to the data processing; if you exercise this right, we will stop processing your data for purposes of direct marketing. If your data is only stored for direct marketing purposes, it will be deleted after you have objected.

Data processing based on consent

If you have given your separate consent to be informed about our company's own products and services, your data will be processed on the basis of Art. 6 para. 1 lit. a GDPR. We use your data exclusively to inform you about products and services of Nordmark Arzneimittel GmbH & Co. KG. You may withdraw your consent at any time. When you withdraw you consent, we will stop the data processing.

Data recipients

We only transfer your personal data to third parties (e.g. to credit institutes for the payment execution, to attorneys for the enforcement of open demands), if a legal norm (e.g. one of the above-mentioned) exists.
We may also transfer your personal data to external service providers (e.g. IT-service providers, companies that destroy or archive data, print service providers) that support us within the scope of commissioned data processing as per our instructions.
We will not sell or otherwise market your personal data to third parties.

Rights of the data subject

Data subjects have the right to obtain information from the responsible party regarding their personal data, and they have a right of rectification of inaccurate data, or of data erasure if one of the reasons stated in Art. 17 GDPR applies, e.g. the data is no longer required for the purpose for which it was collected. In addition, data subjects have the right to have the processing restricted under the conditions stated in Art. 18 GDPR or, in cases according to Art. 20 GDPR, they have the right of data portability. If data is collected based on Art. 6 para. 1 lit. e (data processing in the public interest or in the exercise of official authority) or based on lit. f (data processing in pursuance of legitimate interests), the data subject has the right to object to the data processing on ground of his or her particular situation. We will then no longer process your personal data, unless compelling legitimate grounds for the processing override the data subject’s interests, rights and freedom, or the processing serves the exertion or defense of legal claims.

Information regarding the right to object according to Art. 21 GDPR

If data is collected based on Art. 6 para. 1 lit. e (data processing in the public interest or in the exercise of official authority) or based on lit. f (data processing in pursuance of legitimate interests), the data subject has the right to object to the data processing on ground of his or her particular situation. We will then no longer process personal data, unless there are demonstrably compelling legitimate grounds for processing, which override the interests, rights and freedoms of the person concerned, or the processing serves the purpose of asserting, exercising or defending legal claims. Right to lodge a complaint with the data protection authority

Every data subject has the right to lodge a complaint with a data protection authority if the person is uncertain that the processing of his or her personal data is compliant with data protection regulations. The right to lodge a complaint may in particular be exercised with a supervisory authority of the member state in which the data subject is located or where the alleged incident has occurred.
